Terms of Use
Effective June 6, 2026
1. Acceptance
By creating an account or using EzFormBuilder (the “Service”, operated by RodyWorks LLC, a California limited liability company doing business as EzFormBuilder, of Lompoc, California, “we”, “us”), you agree to these Terms of Use and our Privacy Policy. By clicking “Create workspace,” you accept these Terms. If you use the Service for an organization, you represent you are authorized to bind it. You must be at least 18. If you do not agree, do not use the Service.
2. The Service & accounts
We grant you a limited, revocable, non-transferable right to use the Service per these Terms. You are responsible for your credentials and all activity under your account, for keeping your information accurate, and (for administrators) for enabling two-factor authentication. We may modify, suspend, or discontinue features at any time.
3. Your content & responsibilities
You retain ownership of the forms, documents, submissions, uploads, and signatures you submit (“Your Content”) and grant us a license to host and process it solely to operate the Service. You are solely responsible for Your Content, for the lawfulness of how you collect it, for obtaining all required consents from your respondents and signers, and for using the Service in compliance with all applicable laws.
4. Encryption — non-recovery
Certain tiers encrypt Your Content so that we cannot access, decrypt, recover, or reset it. If all key-holders lose access, the affected content is permanently unrecoverable, and we have no ability and no obligation to recover it.
5. Electronic signatures
The Service facilitates electronic signatures and records the supporting evidence (consent, intent, attribution, document association, and integrity — see how DocuBuilder supports e-signature laws). We make no representation that any signature, workflow, or record satisfies the U.S. ESIGN Act, UETA, eIDAS, or any other law for your particular use; you are responsible for that determination.
6. Regulated data (HIPAA / FERPA)
You may submit Protected Health Information or student education records only under a separately executed Business Associate Agreement and/or Data Processing Agreement. Absent that agreement, you must not submit such data, and the agreement controls over these Terms for that data.
7. Acceptable use
You will not use the Service unlawfully; infringe others’ rights; upload malware; attempt to breach security or access others’ data; reverse engineer the Service; send spam; or harm minors. We may suspend or terminate accounts that violate these Terms.
8. Plans, products & fees
Paid plans and add-on products will be offered; applicable pricing, billing terms, and any additional terms will be presented at the time of purchase, and your purchase constitutes acceptance of them. Fees are non-refundable except as required by law or expressly stated.
9. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that data will not be lost. We provide no legal, medical, tax, or compliance advice.
10. Limitation of liability
To the maximum extent permitted by law, we and our suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, data, or goodwill. Our total liability for all claims will not exceed the greater of the fees you paid in the twelve (12) months before the event or USD $100. Nothing limits liability that cannot be limited by law.
11. Indemnification
You will defend, indemnify, and hold us harmless from third-party claims and related costs (including reasonable attorneys’ fees) arising from Your Content, your use of the Service, or your breach of these Terms or applicable law.
12. Dispute resolution; arbitration & class waiver
Most disputes will be resolved by binding individual arbitration administered by the American Arbitration Association, seated in Santa Barbara County, California, and you and we waive the right to a jury trial and to participate in a class action. You may opt out of arbitration by emailing legal@ezformbuilder.com within 30 days of first accepting these Terms. Either party may bring an individual small-claims action or seek injunctive relief for intellectual-property or confidentiality violations.
13. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. Subject to the arbitration section, the state and federal courts located in Santa Barbara County, California have exclusive jurisdiction, and you consent to that jurisdiction and venue.
14. Changes & contact
We may update these Terms; we will post the updated version with a new effective date and notify you of material changes. Continued use after changes means acceptance. Questions: legal@ezformbuilder.com.
